On August 2, the Federal Communications Commission (FCC) adopted new rules updating the Communications Act’s cable franchising regulations. The Third Report and Order requires “in-kind payments other than the capital costs of public, educational, and governmental (PEG) access channels to be counted toward the statutory five percent cap on franchise fees. It also prohibits local franchise authorities “from regulating the provision of most non-cable service, including broadband Internet access service.
